Spirits and Beings is a registered and protected trademark by The Benelux Office for Intellectual Property.

Anything that resembles the logo and brand identity will be prosecuted. All work is copyrighted. It may not be used by others without permission.

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.spiritsandbeings.com .The core activity of Spirits and Beings is making Fairytale Fine Art and selling these as high quality Fine Artprints in this webshop. During this process I collect a multitude of personal data from my customers.

Why do I have this Privacy Policy?

I am responsible to protect your personal data as well as possible. Therefore, I have to comply with the requirements of the privacy regulations. I would like to be transparent about the types of data I process, the purposes for processing, with whom I share data and what rights you have with regard to your own data. Order in the Shop

When you place an order on our webshop, we store all information provided by you for an indefinite period of time. By placing an order, you agree with this – even if this is not required for all data. With this information we can send an order confirmation of your order and a shipping confirmation.

Types of Data

We process (possibly) the following personal data of you:

Contact details such as name, address, place of residence, telephone number and e-mail address
Bank details such as account or credit card number
We do not record any special personal data relating to, for example, religion, health, sexual orientation, origin or political preference.

We do not check who is using which IP-number unless there is (a suspicion of) abuse.  

Software

My webshop has been developed using WooCommerce software, we host my webshop on a server under own management. We have taken necessary precautions and security measures when it comes to your personal data such as an SSL-encryption and a strong password policy.

Hosting

We use the webhosting- and email services of Elway Hosting. Elway Hosting processes personal data on behalf of us and will not use this data for their own purposes. This party can however collect meta-data about the use of their services. This is not personal data however, Elway Hosting has taken necessary precautions and security measures, both technical and organizational, to prevent loss, abuse and misuse of your personal data. Elway Hosting is obligated to a duty of confidentiality based on the agreement we have with them.

Postal Service

If you place an order with us it is our responsibility to have your order successfully delivered to you. For the delivery we use the services of PostNL for deliveries in the Netherlands. For a successful delivery it is important that we share your name, address and residential details with PostNL. PostNL uses this information with the sole purpose to carry out the agreement of delivery. In case of PostNL hiring subcontractors, they will share said information with these parties.

Payment Provider

For concluding and processing the payments in the webshop I use the payment provider Mollie. Mollie processes your name, address and residence information. They also process payment information such as your bank account number or credit card number. Mollie has implemented fitting technical and organizational measures to protect your personal data. Mollie retains the right to use your personal (anonymized) information to further improve their services and, within this context, share it with third parties. All the aforementioned guarantees in regarding to the protection of your personal data are also applicable to any services by Mollie that uses third parties. Mollie does not store your data any longer than the instalments permitted by the appropriate legal grounds.

PayPal processes (part of) our payments in our webshop. PayPal processes your name, address and residence information. They also process payment information such as your bank account number or credit card number. PayPal has implemented suitable technical and organisational measures to protect your personal data. PayPal retains the right to use your personal (anonymized) information to further improve their services and, in this context, share it with third parties. In the case of a request for a deferred payment (credit facility) PayPal will share personal and order information with the appropriate payment provider. All the aforementioned guarantees of the protection of your personal data are also applicable to third parties used by PayPal that uses third parties. PayPal does not store your data for longer than allowed by the legal terms.

Newsletters

When you sign up for our newsletter, we will keep your name and e-mail address for the duration of your subscription. You can unsubscribe at any time from each of our newsletters. There is a clear way to this in every newsletter. If you do not succeed in terminating your subscription through this way, you can exceptionally inform us in writing a mail with your request to unsubscribe.

Cookies

A cookie is a small file with data that is used to connect different requests by your browser. For example, a cookie can be used to store user settings, to stay logged-in or to match advertisements to interests and preferences that are apparent from your clicking behavior.

Most web browsers automatically accept cookies, but you can refuse or accept cookies selectively. If you disable cookies, certain features of our web shop may not be available.

Providing data to third parties
Of course, we do not simply provide your personal information to others. We do not provide your data to third parties other than (marketing) service providers that we work with or authorities in the event of (a suspicion of) abuse.

Examples of parties to which we provide your data are Google Analytics, a web analysis service offered by Google. In addition, we use Mailchimp sending our newsletters.

We keep all data strictly confidential and with care.

External parties that process the personal data under our responsibility, do so only for purposes and under conditions that we have agreed on with them. We record this in written agreements. By agreeing to this privacy statement, you expressly and unambiguously authorize us to provide the collected personal data to these third parties that we have selected.

How long we retain your data
We store your data for as long as you are a client with us. This means that we maintain and keep your client profile until you make it known to us that you no longer desire to use our services. Such a message also functions as a request to be forgotten. We are required to keep invoices with your (personal) information due to relevant administrative obligations, this information is safely stored for as long as the relevant term for these obligations has not yet passed. Personnel no longer has access to your client profile and any documents made because of your assignment or task.

What rights you have over your data
Based on valid Dutch and European law you, as a concerning party, have certain rights when it comes to personal data that is processed by or on behalf of us. Below you may find an explanation of these rights and how you, as a concerning party, can invoke these rights. In principle to prevent abuse we only send invoices and copies of your data to e-mail addresses that you have made known to us. Should you wish to receive this data on another e-mail address or for instance per mail we will ask you to identify yourself accordingly. We maintain an administration of concluded requests, in case of a request to be forgotten we will maintain an administration of anonymised data. You receive all invoices and copies of data in files that are structured in a machine-readable format. Based on data classifications that we use within our system. At all times you maintain the right to lodge a complaint with Autoriteit Persoonsgegevens if you suspect that we mistreat or misuse your personal data.

At all times you maintain the right to view the data we process that has a relation or may be reducible to your person. You may request such a viewing to our contact in charge of privacy matters. You will receive a response to your request within 30 days. If your request is approved we will send you, via the e-mail address known to us, a copy of all data with an added overview of processors managing this data while also mentioning the categories under which we store this data.

At all times you maintain the right to have the data we process that has a relation or may be reducible to your person be adjusted. You may request such an adjustment to our contact in charge of privacy matters. You will receive a response to your request within 30 days. If your request is approved we will send you, via the e-mail address known to us, a confirmation that the data has been adjusted.

At all times we maintain the right to alter our privacy policy. This page however always displays the most recent version of our privacy policy. Should a new privacy policy have consequences for the ways in which we process recently gathered data in regard to your person, then we will notify you of this via e-mail.
